According to the SSA website, the SSA does recognize common law marriages but only if the state of residence accepts a common law marriage as legal. North Carolina does not recognize common law marriage as a legal marriage in the state, unless the common law partners moved to North Carolina from another state that recognized the relationship as a common law marriage.
Medical and other records in which you have stated you are married or signed as married are not valid proof of a legal marriage relationship. However, the SSA website states that a common law bond can possibly be claimed with specific SSA required evidence. Your local SSA office will provide an explanation of the required proof documents.

You need to find out what you need to do for your future but benefits after his death would not be available until you reach retirement age.
