My 5 year old daughter's dad recently passed away and he was not a U.S. citizen. She was born in the U.S. and he is on the birth certificate.

Call your local Social Security Office and talk to them. They are the only people that can give you the correct answer. That being said, I think you left some information out of your question.
Did he have a social security number and legally work in the US? He would have had to pay into the system in order for it to pay out.
