Eligibility for Survivor Benefits?

Could this be fraud or is the law being bent? My husband was previously married and had a child from that marriage. He and I were married a short time after his divorce and had children of our own. His ex did not want their child to know about his dad and had him adopted by another man, someone who had been part of his life the whole time.

My husband, then died 7 months after it was finalized. Because my husband relinquished his rights and all financial obligations, how are they able to claim survivors benifets if the law clearly states my husband had to be the legal guardian of his child and was not?

Call your local Social Security Office and talk to them. They are the only ones that know the correct answer. Even if this is correct, it doesn't affect the amount your kids will be getting.

Like the previous poster stated: call SS or contact them online. They are very helpful.
I can't help but ask if you are resentful of a child who was basically abandoned by both his natural parents?

I believe this may in some way be considered fraud but you may be the only one who cares?

The decision to report this is yours alone and it is easy to report - just write (or visit) a Social Security office and give them your husband's name and social security number and the "facts" about a LEGAL adoption. Telephoning in this kind of situation is probably not a good idea.

The problem with this is - should you? Only you can answer that question.
The family's financial situation could be considered also. Does the child need this support? I see cases almost every day that I know can be reported as fraud but I

personally elect to not be the one to do the reporting (unless it is a crime or abuse situation).

You may feel that the mother should not be "rewarded" after how she handled the whole situation and that is understandable but your anger or frustration could wind up hurting you more than her.

Just remember - the child is an innocent in this whole situation.

I applaud you for being concerned about this. After all this is our tax money. Fraud should definitely be reported. Ignore those who say it's none of your business. Fraud should be everyone's business.

I applaud Charlotte Lenox for stating that fraud is everyone's business as I surely agree.
I do feel that reporting anything should be done by the person who sees it or becomes aware of it. Reporting can also be done anonymously either on the telephone or in writing. All Reports are taken seriously and resolution has to be documented.

I work part-time in this type of environment and know that some people change their mind after they get to the office - conscience? - or - afraid their identity will be disclosed? No one should feel guilty about reporting someone who is abusing the system because - after all - we are the tax payers.

The "guilty" party may surmise as to who they think reported them but all reports are kept confidential unless a paper is signed giving permission to disclose your name.
