Only the Social Security Administration can answer your question. You can make an appointment at your local SSA and bring copies of all pertinent papers.
The SS office will be able to answer all of your questions.
They may require some sort of "legal" proof that she is his
child. The court papers may be enough but only they can tell exactly what will be required.
You should file as soon as possible as the SS uses the file date as the beginning date and if you have to provide additional proof - it may be several months before your case can be approved. This way, when/if your case is approved, you will be compensated from the date you first filed.
Be sure to carry all court papers with you as well as all SS numbers and birth certificate.
