My son's father and I have a child support case for our now adult son where I pay a back support debt even though my son is in his 20s now. Well his father passed last month and I'm wondering does his wife get the support now even if she is not named in our case. I hope someone can answer this.

That's a really good question. I would say call the child support office and let them know he pasted away and let them know u still owe back child support and u was needing to know who would be getting it. U would think it would start going to ur son now his father has passed away. I wish u the best and hope u find out.

You would have to talk to social services and explain your situation for answers.Being that your son is grown,maybe they can change the arrangement!
This is actually a question for an attorney or the court. The court may decide that you still owe the money and now it will go to your son. They could cancel the order and say now that your husband has died the debt is paid back. I would make an appointment with the social service or who ever is handling your case to find out what can be done.

Your question is something for an expert who knows your case--your lawyer or case worker should be able to help you. I would be afraid anyone answering this as crowd sourcing may lead you the wrong way since this is so complicated, could be different by state and situation.
