Smoking Neighbor?

Is there some legal action I can take about the smoke getting in my apartment from my neighbor downstairs? We are getting sick as if we ourselves smoked. I have a 9 years old affected by the contaminated air too. What can I do to make the air cleaner?

I would certainly complain to the manager, even if it is not a smoke free building. Also, you should check your state or province laws, as there may be regulations against smoking. There are so few places that people can smoke nowadays, and most of the smokers I know DON'T smoke in their own homes! If the manager will do nothing, and there is no other recourse, make arrangements to move out. If you threaten to leave (and, of course, mean it) the manager may rethink his position of doing nothing.

buy a GOOD quality air cleaner with washable filter and run it 24/7 i clean mine once a month. it has a metal filter, i wash and set to dry . just in the kitchen sink , keeps my husbands smoke from killing me off early lol also we have a wood stove and it helps with that smoke as well.

I had the exact same problem years ago in California but the state laws have changed. You do not say what state or city you live in so it is impossible to know if your local laws address this problem. If your city or state has no laws addressing the smoke problem, your only possibility is to complain to the building manager. However, having been down that road before, I would say you have a tough road ahead.

In my situation years ago, I had to move out as the woman below me smoked 24/7 and my apartment and clothes always had a smoky odor. The manager did nothing.

If it is not a NO Smoking building there is little you can do, but move to a Non-smoking apartment building.
